ISLAMABAD: The Islamabad High Court (IHC) reversed the trial court’s rejection of Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan’s Toshkhana case inadmissibility petition on Tuesday.
The PTI chief’s petition, reserved on June 23, was decided by IHC Chief Justice Amir Farooq.
The judge ordered the trial court to hear and review the PTI’s counsel’s arguments in the brief order.
“The trial court should decide on the PTI chairman’s plea in the Toshakhana case in 7 days,” the IHC said.
On May 10, Additional Sessions Judge Humayun Dilawar accused Khan in the Toshakhana case despite admissibility arguments.
The PTI head approached the IHC, which had postponed criminal proceedings till June 8.
On June 23, Justice Aamer said he will decide the petition after Eid ul Adha after the hearing resumed in June.
The PTI chair opposed filing a case after a certain time in his petition.
Moreover, Khawaja Haris, his lawyer, said a complaint could only made four months after submitting the return.
While, The judge noted in an order that the trial court’s decision left crucial legal problems unresolved.
The judge stated that the trial court should decide on the application after hearing the arguments afresh.
The order also stated that the parties’ arguments showed that the court’s conclusion was unspecified.
The IHC top judge said that answering eight questions, including the case’s jurisdiction, is crucial.
The petition dismissed without explanation, leaving major legal issues unsettled.
